1. Acceptance of Terms
These terms govern the Cyberxperts website, its forms, resources and complimentary security assessment. Read them before using the relevant features. If you do not agree, do not use those features.
Professional services require a separately agreed quotation, scope of work or service agreement. That agreement governs the engagement and takes precedence over these website terms where they conflict.
Nothing in these terms excludes rights or obligations that South African law does not permit to be excluded.
2. Website Services
The website provides information about our services and products, resources, enquiry and recruitment forms, and a complimentary security assessment at no cost.
Assessment results are based on the answers supplied. They do not test your systems, certify compliance or confirm that your organisation is secure.
Results and summaries are general guidance. Information supplied by users is not independently verified. Obtain suitable professional advice before relying on a result for a material security or business decision.
An enquiry, report request or acknowledgement does not create a service engagement. It does not appoint Cyberxperts to monitor systems, respond to incidents or correct weaknesses. Urgent assistance must be expressly agreed. Do not rely on a general website form as an emergency response channel.
3. Your Responsibilities
Provide accurate and relevant information to the best of your knowledge. If you act for an organisation or supply another person's information, you must have lawful authority to do so.
Do not submit passwords, access keys or sensitive records through general forms. Use an agreed method where such information is needed for an engagement.
You remain responsible for managing your systems and deciding how to use general website information. Responsibilities for professional work are set out in the relevant service agreement.
A job application or talent pool submission does not guarantee employment, an interview or a future opportunity. Recruitment information is handled under the Privacy Policy and the notice supplied when you submit it.
4. Fees and Payments
Browsing the public website and completing the complimentary assessment do not create a payment obligation or subscription.
Professional fees, payment dates, expenses, cancellation and refunds are governed by the accepted quotation or service agreement and applicable law. Website descriptions invite enquiries and do not, by themselves, create a binding offer or guarantee product availability.
5. Acceptable Use
You must not use the website to commit fraud, impersonate another person, distribute malware, harass others or infringe their rights. You must not access restricted information, evade access controls, disrupt the website or abuse its forms.
Security scans, testing and attempts to exploit our systems require prior written authorisation covering the activity. Reporting a suspected weakness does not grant permission to continue testing, access other people's information or claim a reward.
We may investigate suspected misuse, preserve relevant evidence and report unlawful activity where permitted by law. We may seek lawful remedies for resulting harm.
6. Intellectual Property
Website content, images, branding and software belong to Cyberxperts or their respective owners. You may view public material and keep a copy for internal reference, subject to any specific conditions accompanying it.
You may not sell, commercially republish or alter material to suggest Cyberxperts has endorsed you. Do not remove ownership notices or use our name or logo without permission, except where the law permits.
An assessment report may be shared within your organisation or with authorised advisers for its intended purpose. It must not be presented as certification or an independently verified finding by Cyberxperts.
Rights in professional deliverables are governed by the relevant service agreement.
7. Submitted Information and Privacy
You retain ownership of material you submit. You authorise Cyberxperts to receive, store and use it to handle your request and for the lawful purposes explained in the Privacy Policy and any applicable notice.
This permission does not authorise unrelated use of personal information or publication of confidential client material. Acceptance of these terms is not blanket consent to marketing or international transfers.
Our processing of personal information remains subject to POPIA.
8. Liability
This section limits Cyberxperts' liability for use of the public website and its general assessment results. Read it carefully before using those features.
To the extent permitted by law, Cyberxperts is not liable for indirect or consequential loss arising from that use. This includes loss of profit or business opportunity where the loss is legally classified as indirect or consequential.
This limitation does not exclude liability for fraud, wilful misconduct, gross negligence or any liability that cannot lawfully be excluded. It does not reduce an obligation expressly accepted in a service agreement.
You are responsible, to the extent permitted by law, for loss that we can reasonably prove was caused by your unlawful use of the website or your unauthorised submission of material. This does not require you to cover loss caused by Cyberxperts' own unlawful conduct or negligence.
Liability for professional services is governed by the relevant service agreement and applicable law.
9. Website Information and Availability
General website information and assessment results do not guarantee a security, compliance or business outcome.
We do not guarantee uninterrupted website availability or that general information will always be current. Assessment summaries may contain errors or omissions. A high score does not establish that systems are secure or remove the need for appropriate controls, monitoring and further assessment.
We do not control external websites or guarantee their content or availability.
These provisions do not remove a statutory warranty, duty of care or obligation that cannot lawfully be excluded.
10. Restrictions on Access
We may restrict website access where reasonably necessary to address misuse, a security risk, a breach of these terms or a legal requirement. Immediate action may be needed to protect systems or information.
A website restriction does not cancel a separate client agreement or remove accrued rights. Suspension or termination of professional services follows the relevant agreement and applicable law.
11. Governing Law and Disputes
South African law governs these terms. Disputes may be brought before a court or other body with lawful jurisdiction.
You may contact us to seek a resolution. This does not prevent either party from seeking urgent relief or exercising statutory rights.
If a provision is unenforceable, it is ineffective to that extent. The remaining provisions continue where they can operate independently. A failure or delay to enforce a right does not, by itself, waive it.
12. Changes to These Terms
We may update these terms and publish the revised date. We provide notice and obtain acceptance where required by law.
Changes do not retrospectively alter an existing engagement or remove accrued rights. Variations to a service agreement follow that agreement's requirements.
